Objectives
Reduce health and environmental exposure to vinyl chloride in industrial processes, raise awareness of its toxicity and safer alternatives, strengthen prevention-based programs, and guide identification of potential releases in industrial facilities.
Coverage and Exemptions
Covers importers, distributors, manufacturers, industrial users, and commercial users. Exempt: polymers containing vinyl chloride as a monomer; products regulated by the FDA (food, drugs, cosmetics, household/urban hazardous substances, consumer health products); product standardization under DTI-BPS; and vinyl chloride in articles as defined in EMB MC 2020-005, unless otherwise specified.
Prohibited Use

Covered entities must complete the CCO Registration module of the EMB Online Permitting and Monitoring System (OPMS) and secure a Registration Certificate. This applies to new applicants, holders of existing Priority Chemical List (PCL) Compliance Certificates or PCL exemptions (treated as new applicants), and holders requesting amendments. Requirements include:
- Environmental Compliance Certificate (ECC). Other permits (Hazardous Waste Generator Registration, Wastewater Discharge Permit, Permit to Operate for air pollution sources, PCO accreditation) must be complied with but are not prerequisites to CCO registration.
- Chemical Management Plan (exposure prevention and release control, housekeeping and occupational hygiene, safety equipment, PPE)
- Contingency and Emergency Plan consistent with DAO 2013-22
- Substitution and Phase-out Plan for stocks intended for prohibited uses
- GHS-compliant Safety Data Sheet, process flow chart, worker training certificates, facility photos, latest Self-Monitoring Report, and proof of fee payment
The Order also sets handling and storage requirements for facilities.
Importation Clearance (CCOIC)
Importers must secure a CCO Importation Clearance Certificate through the OPMS.
Other Provisions
- Compliance is monitored through Self-Monitoring Reports under DAO 2003-27, with sampling and testing for complaints.
- Issuance of CCO registrations and importation clearances will be devolved to EMB Regional Offices three years after effectivity.
- Non-compliant chemicals may be impounded or confiscated; violations are subject to sanctions under RA 6969, DAO 1992-29, and DENR MC 2005-003.
Effectivity
Takes effect fifteen (15) days after publication and upon filing of three certified copies with ONAR, UP Law Center.
